WELL SOMEONE HAD TO SAY IT…..

A mediator is not here to baby you or “take your side.”  We’re here to make sure you understand there are two sides to every coin and at least two sides to every story (and the truth usually lies somewhere in between).  Sometimes people take unreasonable positions or lack the ability to view the situation from the eyes of the other party.  A good mediator sometimes has to have a “reality check” with the parties with questions like, “Are you absolutely sure you’re going to get that in Court?”  Nothing is guaranteed in this life other than, as the saying goes, death and taxes.  People in dispute tend to get tunnel vision and see things only the way they want them to be seen.  A good mediator has to play devil’s advocate at times and help people realize that they might be wrong, they might not get to tell the Judge everything they want, Court is not like it seems in television and they might (gasp) lose.

I am here to make sure you get heard.  I also make sure you heard the other party’s position and how that might change your situation.  To make that happen I oftentimes have to say something you might not like and I am not known for dancing around a problem.   Rather, I tend to jump right on it and shake it around a bit.  That’s my job and I take it, and your situation, seriously.

CANOVA MEDIATIONS

Working hard on new office in Van Buren to start mediating disputes in Crawford and Sebastian Counties.  Should anyone wish to use me for mediation between now and February 1, 2012, we can certainly figure out an alternate location for the mediation.  Just call my Van Buren office at 479.471-7778 or my Fayetteville office at 479.582.5800. You can also reach me via email at kcanova@armediations.com.

Mediations have increased tenfold recently as the public has become more educated about this process and the potential benefits to them.  I have so many friends who have asked if I am now offering mediTATION and I have responded that if I have to learn how to do yoga, meditate, burn incense or stand on my head I’ll do just about anything to help people resolve their disputes!

More calls are coming in with people in dispute, but not necessarily legal disputes.  As an example, parents having a disagreement with their now grown child are in conflict and in need of a third party to sit down with everyone and provide a venue for everyone to voice their concerns/issues, hear the other side’s response and then brainstorm on how to resolve the conflict.

Mediation is the way of the future.  Get on board!
